retention of planning query

    we are half way through a house sale only to find that the extension that has been on the house for about 6 years needed planning. The vendor genuinely didn't believe it did as it was under the square footage required, but as the level of the roof was changed, it turns out that it did. my query is, that given we live in this house already and really want the sale to go through, how does the vendor go about getting retention, as he's been really slow with everything else and I want to push this through.

    I'm a first time buyer by the way....

    The permission would be relevant to the building and not the owner. The owner himself could make the application which is what Id recommend or alternatively you could make the application and other than than the normal plans, maps etc you will simply need a letter from the owner giving his consent for you to make the application.

    A letter accompanying the application can be submitted to explain all this to the planners but your architect/technician/engineer will sort this for you in any event.

    You say that you live in the house already, which seems unusual.... Maybe you rent it currently.

    Anyway, as Muffler says, Planning Permission applies to the property not the person. Assuming it is a straight forward planning application, (and check this with a professional before), you could assume a price for obtaining the retention PP - say €1,000 - and ask the vendor to drop the seling price by that amount to save him having to make the planning application himself.
