Will O2 be decent enough to cancel the contract as I have no signal at all in the house?

    Bout 10 months left.

I logged a query on their forum but no reply yet. Surely they're breaking the terms of the contract by not providing an adequate service (or any service in this case)?

No, since you're the one who's moved.

It's worse than that, he entered a contract where he was never promised any service in the first place:o

    section 4.1 in the t's&c's
4.2. There are a range of factors that impact on the speed and quality of network service you will receive, such as signal strength, distance from the local site and the number of simultaneous users on the local site and we cannot guarantee that your connection will reach any specific speeds.

They never promised you any service, there not breaking any contract, you are if you don't pay. :(

Even if you were at your original address, this is not the case. You've 7 days cooling off at the start of every contract. After that, you're considered to be in acceptance of the standard of service provided. Same with all networks.

It's only student BB, so the cancellation fee won't be too bad at €99.90 for ten months (you just pay the monthly charge). Tbh it happened to me cos I lost the modem, you're nearly as well to just keep paying the bill at a tenner a month rather than forking out the hundred in one go. I was with VF though for BB so cost me twice as much, lost the thing the first week!

That's interesting, I should have consulted with O2 before moving

Cheers. I guess my argument would be that we are not speaking in terms of up/download speeds or ping times. The modem is unable to connect to the O2 network. I would consider this to be a failure to provide service on their part.

Haha they're wonderful sometimes aren't they :) I guess worst case I could take it up with Comreg but it's a lot of hassle for E160.

I never said that, but you're claiming O2 are in breech of the contract, but you're the one who's moved, so I fail to see how this is O2's problem. All the roll eyes in the world won't help you when you're wrong.

You can ask, but they don't have to do anything for you.

The modem is capable of connecting, and O2 are providing a service, you've just moved to an area where they don't have service. You can consider it to be anything you like, but the failure is not on their part.

Are you for real or a WUM? I didn't sign up to get service at a specific address, if O2 cannot provide service where I live then that is their problem, not mine. How is it anything other than a failure on their part? Actually **** off with you're opinion, you're either a WUM or a retard.

    that's majorily uncalled for!!!

Have you even rang them yet other than posting on their forum? I doubt it... Why don't you stop speculating, ring them and see how you actually get on.

Jot_el's opinion is actually fact in this scenario and he knows what he's tallking about. His opinion is also pretty highly thought of around here, so don't be surprised if nobody thanks you for that last post.

nennec you are completely and utterly wrong. I know consumer law back to front.

No mobile phone company would be under any obligation to refund you in the circumstance you described above. You are plain incorrect, no matter what your personal opinion is.

It's completely unreasonable to expect o2 to foresee the future when you bought the thing - I'm sure the shop don't have a magic crystal ball that foretells which part of the country you're going to up sticks to.

Your post and tone are way out of line, I find the terribly offensive and uncalled for and have reported it. In fact, I'm calling troll.

You come to the forum looking for advice and when people tell you O2's actual responsibilities you act like a child, whats worse is you were dumb enough to also abuse a mod in the process.
