'Unregistering' for income tax ?

    Hi,

    Does anyone know how to 'unregister' myself for Income Tax? I am a PAYE employee but as I also get Share Options I have to fill out a Form 11. This form has fields for ALL the non-PAYE items that are relevant to me. Last year however I started to get Reminder notices for 'Income Tax', and it seems someone within the Income Tax division filled out some sort of return for me without my consent, as a result I was unable to fill out my normal Form 11 via ROS (as the system said there was already a filing for me for that period) so I had to resort to the paper version. I phoned the Income Tax division and at first they denied there was any such filing and referred me back to ROS, who referred me back to Income Tax, who then admitted there was a filing but claimed they hadn't created it and referred me to PAYE, who said it was an Income Tax filing and referred me back to Income Tax. Anyway having filed the From 11, and getting an assurance on the phone from the Income Tax department that it wouldn't happen again this year I decided not to pursue it further.
    A couple of weeks ago however I got a Reminder Notice from the Income Tax division telling me that I was late for my 2009 filing, as a PAYE customer my 2009 filing is not due until October. So, as I get the distinct impression they simply do not know what they are doing in the Income Tax division, does anyone know how I can unregister myself for 'Income Tax' to put an end to this junk mail and more importantly prevent phantom income tax filings from blocking my genuine ROS PAYE return, is this possible?

    Are they saying that you are late with your 2008 Form 11. And is it the 2008 Form 11 which you sent in on paper ?

    No its the 2009 tax return they are talking about, which would be due if I were an Income Tax customer, but I'm not I'm PAYE. My impression is that they are inadequately trained and 'the computer' is effectively in charge, it says I am registered for Income Tax so they will keep treating me as though I am until I manage to 'unregister' myself. Hence the original query.

    No. The 2009 Form 11 isn't due till this October.

    You sure they are asking for that ?

    Filing with shares pushed you into self assessment and the computer sends out reminders automatically.

    If you still have share interests then you will be required to file annually.

    A letter to self assessment will remove you from the system but it's no big deal really. Not worth getting upset about.

    You sure they are asking for that ?
    Yes, the preliminary payment for Income Tax for 2009. It's in black and white there's not much room for ambiguity.

    I don't mean to be rude, but it always amazes me how many people respond to messages on webforums without actually reading the original question. If you read my post above you will see that I am fully aware that receiving shares pushes me into the self assessed category. Every year I file RTOS payments when shares have been purchased and then fill out a Form 11 in October as a PAYE customer. My problem has nothing to do with filling out Form 11 per se but rather with the fact that the Revenue have somehow got the notion that I am liable to be assessed as an Income Tax customer which is incorrect. They have even taken the unusual further step of filing erroneous income tax assessments on my behalf without my knowledge. These incorrect assessments block my genuine assessment from being uploaded to ROS, hence my problem.

    I didn't realise PAYE workers could return a Form 11 without being fully self assessed.

    A PAYE worker would usually have sent in a Form 12 but as you can't do so on ROS you must send in the full fat Form 11 which requires you to register for full self assessment I thought.

    (In fact, from expierience at work, its impossible to upload a Form 11 on ROS without being registered for self assessment).

    Dude, you simply do not understand what I am saying. A PAYE worker does not fill out a Form 11. They Fill out a Form 12.

    An RTSO1 (Not RTOS "Relevant tax on share options") has nothing to do with filing. It is an obligation and is not filing but automatically pushes you into self assessment. Self assessment does not mean you cease to be a PAYE person or makes you self employed. It merely means that you have to file a Form 11. You can exist in both systems at the same time. You don't have to be either or.

    Revenue are correct. You are incorrect.

    Well actually, what you said was

    Your preliminary payment and the actual return are two completely different issues (although as a PAYE worker you may not have a preliminary liability). Anyway, I second Mr Incognito.

    if you're hitting the system under self assessment and you haven't paid preliminary tax, it will automatically generate a reminder to you, whether or not you owe preliminary tax. It's just a reminder.

    As other have said, you simply haven't paid any Preliminary Tax for 2009.


    When filing your 2008 Form 11, did you fill out the on-line payslip on ROS. When doing so, you should have been asked what amount you wanted to pay for preliminary tax for 2009. If you specified 0, then they shouldn't be sending reminders to pay 2009 preliminary tax.

    Are you of the opinion that you will have no tax liability outside of your PAYE income for 2009 and that a zero payment would be OK ?
