can my hours be changed after 13 weeks?

    Hi Guys,


    I am not looking for legal advice....but have been searching online for 3 hours for the correct information and can't find it.

    I am working in my company for 18 months and have an "upto 40 hour" contract so basically a zero hour contract but have always done 45 hours per week.I had a customer complaint go in about me and since my manager has started reducing my hours to 20-30 per week.

    When I approach him he said that I was not guaranteed any hours and should be happy with what I have.I have spoken to some people and they have told me that if I have worked a set amount of hours for more then 13 weeks or 101 days that it becomes an implied by custom part of my contract.

    I have read a lot of articles now about implied parts of contracts but none about hours or what the actual time limit is were it would become implied?

    Would anybody know a site with this information or have experienced something like this???

    I can not afford to loose these hours going forward

    I honestly don't think there is much you can do about it. My daughter had the same problem, she had lots of hours for 2 years, then recession hit and her hours were reduced by over half. Her contract of employment stated the same as your's, up to certain hours only. Sorry I'm not much help. Perhaps someone else may know more but that was her experience.

    You can sign on for the rest of the time though as long as you have, I think 3 clear days that you are not working, not 100% sure on that point though but your local social welfare office will tell you.
