Redundancy

    Just wondering if anyone has any ideas on this, a friend of mine was made redundant and a redundancy package was agreed and although she works for a company her boss refused to pay up. Any help as to what her right would be or how she could have them enforced would be much appreciated. The company in question is in funds but simply won’t pay. There is no question of unfair dismissal.

    i am not 100% on this but as far as i know the company has a year from date of redundancy to pay it.

    there is also a form which has to be signed by employer and employee which is a simple thing that a friend of mine never signed. he brought a case to some appeal court seeking compensation on top of the redundancy but got refused as he never signed the form. apparently its the employees responsibility to make sure its signed.

    i could be a mile off on that info but there is a phone number on that website and they answer any question you have

    With whom was the redundancy package agreed with ???

    With her union but as with must unions hers is less then useless and although they have offered to provide information regarding the terms of the agreement and general help etc. they will take no action. What I’m wondering is whether or not this would have to go to the EAT or can it go directly to court. Her opinion is that the Employment appeals tribunal is a waste of time. Especially if she wants to get lawyer involved as the legal cost would leave her with about 5 Euros after the EAT decision.
