Advice on being caught with no car tax/ insurance and vehicle being seized

    Hi,

    I need some advice on what to do about a sticky situation I've gotten myself into. I was stopped at a garda check point yesterday. I had no valid NCT/ Tax or Insurance disc on display. The car was taken from me. Before anyone says something like "well you deserved it", I know I did, and I was stupid driving it with the requirements. I have been suffering financially and I could not afford to tax car, etc. My insurance was out since Jan this year and tax out since Mar last year, and my NCT has been out 2 years. The guard didnt really mention anything about NCT, but he told me I had to produce log book, insurance cert and tax in garda station in 10 days and I could get my car back. I immediately went online and started an insurance policy, but this wont be valid unti Monday morning, and now have to try scrape money together to back tax car. But will they let me take the car without valid NCT even though it wasnt mentioned to me? Also, I was advised by a guard I know that I will probably be summonsed to court for not having the car insured on the day I was stopped. I am supposed to be going away for a year to work abroad, if I have a summons will this effect that? I was also informed that I have to pay a fee to get the car released, which I cant afford. Would I be btter off letting them keep my car and I try find a cheap run around, as I need my car to get to and from work. I am sick with worry, as I am already under serious financial stress. Can anyone offer some advice that may be of use to me? Thank You!

    Not having insurance is a serious matter and you need to talk to a solicitor. You may end up with a large fine, prison and a driving ban.

    Visas and the like generally aren't affected until you have a conviction, although some countries also ask broader questions.

    If you are going away for a year, do you really need a car?

    As has already been stated having no insurance is one of the more serious matters which will result in a fine and you may be disqualified from driving. If its a case you have been disqualified from driving or are currently disqualified you may face a custodial sentence.

    My advice is get legal advice from a solicitor before you go to court.

    As for your car, well you can go to the station where your car is and sign a disclaimer. By signing a disclaimer you give up all rights to the car and it will be scrapped at no cost to you. Or you could have the car towed from the station once you pay the fees involved. The fees are 125 euro for the first 24hrs and 35 euro for every 24hrs or part thereof thereafter.

    start looking into the difference between common law and civil law
    whats legal and lawful
    theres no easy way out but this might help in future

    Sorry OP, this isn't the usual case of "bring in the relevent documents and get the charges struck out"...this is serious.

    First of all, find someone understanding and borrow the money to tax and insure the car and make sure you have a valid driving licence.

    Then worry about everthing else. NCT is ok, as you will not get one in the next few weeks without a car or money.

    Never know, 3 responses so far :D. I know an Idiot who was caught at Xmas without all 3! Wondering how this case went or if anyone knows of a similar one, what was the Penalty?

    I would guess that the law, and punishment has changed a lot in 6 years for these offences.
