Does the valve remain closed when you switch the heater on?

yes the valve stay closed while the heater is on as soon as you switch if off the valve opens and dumps the water.

    Is this a new problem?

Did you check that you have 12v at the valve when the heater is off? There is a 1A fuse for this continuous 12v input. or just dissconect that wire anyway and check the connection it could be loose. The fuse should be under a cover on the electronic control unit near the top of the heater.

If there is 12v on that cable then the temp sensing part of the valve is broken (probaly some form of bimettalic switch) and you would have to replace the valve.
