Can I use a dissolved company/business name

    A search on the CRO found a company which had the same name I wanted to use.
    However it says it was dissolved in 2004, would I be able to use this name now?

    Also does it matter if I won't actually be starting the company for 6-9 months? (Reason I want it now is just in case it someone else takes it in the mean time).

    Unfortunately not. A dissolved company even though no longer on the register can be reinstated at any time up to 20 years afterwards. This is assuming someone would be willing to go to such an expensive exercise.

    So you cant use its name for 20 years afterwards. I am not sure if there is any way round this other then to register your business as a business name instead.

    You read my mind. That was my next question.

    Is there any regulation over business names? All names on the CRO search are companies (I think).
    I would be a sole trader for at least 2-3years anyway, so could other sole traders use the same name then too?

    Also if I wanted to be a Ltd co. in a few years can you mix up the company name so that it's essentially the same but slightly different.

    E.g. Current company dissolved is called:

    'DBRAN Bakery Services Ltd' , Could I call mine:

    'DBRAN Ltd' or 'DBRAN Bakery & Cookery Services Ltd'

    Its the first part of the name thats most important, I have seen companies with alternatives like e.g. D-Bran or D_Bran etc.

    There is no regulation on business names other then you have to register one or the banks will not cash your lodgements. Other then that I go into CRO and register microsoft as my business name tomorrow and there would be not problem.....(initially :) but of course I would soon be in trouble with the real microsoft)

    You can register the company with a similar name but it is up to the CRO to reject it if it is too similar to an already formed company. Doubtlessly I would suspect that if the company is actually struck off a number of years they may be more inclined to allow a name then if it was a company still trading.
