Hi, I live in a private housing estate; it has not yet been taken over by the council. For the past week some one has taken up residency in a camper van in a parking space. Anyone have any opinions on the legalities of this before I ring the council or guards? Thanks.

I imagine its delt with on the fact its not a designated camping sight. However if the estate is not taken over yet best of luck on this one.

oh no I hope you are wrong. We are really in a catch 22 here; builder in liquidation; council can't really help us much but it helps if you are prepared before you ring them.

I think the Gardai are your answer - this is illegal parking. You could also contact Health and Safety as there are bound to be health issues arising out of of this, ie, dumping etc.
But unless you kick up and make yourself heard you will get nowhere. Make up your mind that you wont stop until the problem is sorted! Or else you will shortly have their friends pulling in, and then their friends and - you get the picture!
If all else fails get onto your local newspaper and/or radio station - this very often has the desired effect and gets people acting on your behalf.
Best of luck and keep us posted.

What area of statute law has this chap violated? Can you quote the act and section?

At best he is a tresspasser and thus a civil matter.

Definitely sounds civil not criminal. Define 'private housing estate'. Are we talking that you need a code to get in, with gates and such, or can any joe soap drive down your road - because that would be a public place to which members of the public can have access.
How exactly is he parked? Unless he is breaching some Road Traffic Byelaw like double yellow lines or parked dangerously, the council or Gardai will issue a ticket at best. Otherwise the Guards (other than ascertaining who is there) will leave him be. What can they do?

I'd be interested to hear what the council have to say or do. Perhaps the wife turfed him out for the week?
