I can't tell you the sheer amount of times I've heard this. It is not true, if there is nothing wrong with the item you are entitled to nothing, STOP MAKING UP LAWS AND PISS OFF!!! AUGH!!

But it's so much fun to do it, just to see that red hue of rage your face takes on as you struggle to comprehend how anybody could be so stupid! :D

Yeah, probably because the shop is being nice.
They don't have to do it though.

You know, I don't think there is anybody on this island that knows all the laws. I would doubt it anyway.

You don't have to be such an asshole about it,just give them a credit note.

People don't seem to grasp how easy it is to copy Music CDs, hence why we don't take them back for any reason. "Faultys" Will just be exchanged.

IF it's still in the wrapper you could give them a refund though.

Pretty sure that's against the law. You're right about people not knowing them.

Its not. He only has to offer one of the three Rs. Though the customer doesn;t have to accept the R that is offered. If the customer doesn't like the form of readdress, the next step is decision by SCC.

We normally do, offer credit notes except for Music CDs. When people start quoting laws and their rights, they gets their rights and nothing else.

Replacement, Refund or Repair is the law and it's up to shop.

This actually is against the law. If someone wants a refund in this instance they can demand it.

Might as well use this opportunity to remind people that, if something is incorrectly priced, you are not legally entitled to the lower price.

You get people who buy like 6 dids, return them a few weeks later wanting to exhange them all for something else cause they don't like any of them. I believe there are Chartbusters and Xtra Visions to rent from.

Blah blah recession, blah blah at least you have a job, etc. etc.

Some shops used to let you return things you didn't like to be fair, so it's easy to get confused as to what you're entitled to when the shops change their policies.

I hate that I'm expected to know all the laws in the country as ignorance is no excuse of breaking them, yet I'm not allowed defend someone in court.

Come on now, which is it?

Not in Ireland but the US has a lot to answer for, buy something use it a few times and return within 7/14 days for refund.

THEN they complain when new items they buy are 'opened'.

When you buy goods from a retailer, you make a contract with him. He agrees to provide certain goods to you for a certain price. If your purchase turns out to be faulty, the retailer, not the manufacturer, is responsible to you and must sort out your complaint. You are entitled to a refund, a replacement or a repair. You do not have to take a credit note if your complaint is covered by the Sale of Goods Act. You can insist on a refund, a replacement or a repair.

I worked in a British chain and all stock came in with sterling labels. Everyone had it drilled into them to remove the sterling part but obviously a few were missed. Then customer comes in and says we legally have to sell it to them for that price. They usually calmed down when I explained it's sterling and it should have been removed, but if they really stick to their guns I say I will accept the label price, now that will be 10 British pounds please! That usually shut's em up.

That still doesn't clarify whether the customer or retailer chooses the repair, replacement or refund just that you are entitled to one of them.

I assume if the customer can insist on one, they can pick which one to be insistent about, but yeah I suppose it doesn't technically say it outright. I've never been denied a refund for a faulty item though, even if they offered a reapir/replacement first.

  • Closed Accounts Posts: 1,956 ✭✭✭consultech

Sale of Goods/Supply of Services folks; Fairly basic stuff.

If it's not fit for the intended purpose, or faulty, etc etc, you are entitled to a refund. The rationale is: Why would you trust another replacement product from the same retailer?

  • Registered Users, Registered Users 2 Posts: 3,015 ✭✭✭Paddy Samurai

Replacement, Refund or Repair is the law and it's up to shop.

Think you can op for the cash refund,i know on a couple of occassions i did.(only in places were i wanted nothing else).
Fit for use...........i love that phrase.
Usually go for a credit note myself.

Here's a tip, stop returning stuff all the time.

Buy what you need, if it doesnt work get a replacement. Simple as.

All this "I'm allowed to....." nonsense smacks of someone with too much time on their hands.

I hated the way golden disc use to get you to bring the CD sleeve up and then load the CD from the drawer then if it was bouncing when you got home they would try to convince you that it was your fault....

I reckon CD shops and the likes of xtra vision will be dead prity soon so it should be a calmer world...:)
