Unfair dismissal with '[SNIPPED]' ?

    Hi
    Im just looking for some advise and tips on a case of unfair dismissal.
    I worked for [SNIPPED] as a [SNIPPED] for 18 months and in september of 2009 i took a week of work. The week was made up of overtime hours and coverage for other staff.All staff and bosses were also aware that this was the week leading up to my [SNIPPED] competition. when i returned after a week and my contest the boss had given my job to a new employee.
    The reasons he gave where "we needed someone to cover while you were away and you told me a month ago you were thinking about leaving". I fought with him that i had no intention of leaving and if i did i would have handed in a written notice.
    Anyway I brought this to the right comminsher and provided a huge amount of paper work and evidence to show how everything that happened. And next week [SNIPPED] a hearing will take place.
    I just want to know if anyone has any advise about what i should expect at the hearing? I'm feeling very nervous and i know i will be very imtimidated by the [SNIPPED] bosses.
    Also does anyone know what i would be intitled to if i succeed?

    Ok OP.

    I could have simply deleted this thread for being in breach of the charter.

    Instead though, you need to understand that you are in the process of having a hearing and having your issue dealt with. Was it your intention to compromise this process by publicly posting the employers details and enough information to identify yourself on the Internet? ..... Was it?

    We have rules here for a reason. If you want to go out there and compromise yourself, your identity and potentially your case at the Rights Commissioner or indeed before a Court then that is ultimately your prerogative.

    What if your employer was within their rights? Have you considered this?

    In future, deal with a solicitor for your legal issues and naming companies here will result in nothing more than a SNIPPING and potentially an infraction or Ban for the user.

    While I have some level of sympathy for your predicament and indeed wish you well at your hearing, we can't allow baseless allegations be leveled against anyone here, it is not a Court etc.

    I can't help with the intricacies of the hearing, but a few words of general advice. If you think you're going to be intimidated and are feeling nervous, step one is to slow down how fast you talk. People are inclined to speed up when nervous, and it shows.

    When/if asked a question, don't feel you have to start talking as soon as it's over. Take a breath, exhale, breath in again and then start your reply.

    If they try to intimidate you by talking over you, look at them, keep your voice low, say "Please don't interrupt me" and continue where you left off.

    Dress well, don't swear, don't make random accusations about other things, try not to make it personal against an individual.

    No worries. Let us know how you got on. I presume you have this already, but bring a copy of everything you submitted so that you can refer to it if you want - like if they say "the conversation on the 16th", you can refer to your notes to see which conversation they're talking about.
