Need some advice please.

    Hello.

    Me and my family have recently moved back to Ireland from Scotland. I have found it hard to get work since i came back and have not had the best of luck either.

    We moved into a house at first and paid the deposit ourselves as we put some money buy for this. We arranged our benefits but my as my partner is Scottish, she has to go through the whole habitual residence thing. So until we get our benefits sorted, me, my parner and two children are living on my €196 a week. We had to move out of our house within two weeks as the house was riddled with flees and the kids and ourselves were bitten alive.

    The landlords helped us. They gave us back our deposit and month in advance, plus paid for 2 nights in a hotel for us. We were there for over a week and a half and had to spend some of our deposit money to keep a roof over our heads. We then found a nice house close to the school where we registered the oldest child and we love it here. The trouble is we still owe money on the deposit and are waiting to get our rent allowance sorted.

    We went to our local CWO and they will help us only on the condition that my partner provides a letter stating that she isnt claming benefits of any kind back in the UK. Now we have contacted the Income support people in Scotland dozens of times, even the CWO officer has rang them and spoke to them. They did confirm that My partner was not in reciept of any benefits in the UK but they will not provide any letter of any sort. Untill we provide a letter, we cant get paid.

    Our rent and bills are nearly due and im close to cracking up. If anyone has any advice of any sort that could help us please tell me.

    Get an email or fax from the income support people stating your partner has no claim with them? Did you apply for child benefit for the two kids? Did you apply for child dependant payments on your welfare claim? Did you apply for rent allowance for yourself from the CWO?

    Can you claim for your partner as an adult dependent on your claim instead of her claiming in her own right? You should be also able to claim for the kids as well.
    Who is paying you 196 - Social Welfare or the CWO?

    Thats the thing, we repeatedly asked the income support people for an Email or a fax to the CWO office. At first they said they would send a letter to our address but it never came, then we rang them back and we got on to someone else who said that under no circumstance would a letter, fax or email of any sort be sent as it is against the law and that person claimed to be the head honcho. Honestly what does it take to just send a bloody fax.

    Were in the proccess of claiming child allowance but need to get a letter from the Gardaí to say that the youngest child is living in the country, we dont need one for the eldest as he is registered in school already and we have a letter from the school.

    We did apply for rent allowance under my name as the main person but its the CWO thats looking for the documentation in the first place.

    Thats what we are doing, well she has a claim in for Jobseekers but that will take at least 8 weeks they say as she has to go through the habitual residence thing and the CWO said they would assist us untill that comes through but only on the condition that we provide that letter from income support.

    Its the social welfare that are paying me €196. it doesnt even do us for half the week and literaly had to beg for the last 2 weeks. I took my phone into cash convertors then this week. Bills have started to come through the door now and i done know what to do.

    Surely there is someone i can go to to push the income support for that letter. British Embassy maybe ? Thoughts ?

    Go into your local dole office on Tuesday. Ask to speak with an inspector. Tell him that you have a current claim in his office. Say that you need him to check that your partner has no current claim open in Britain. Give him your partner's British record details. The inspector should have the contact fax/phone numbers and can request a fax from the British office. They should be able to send him a fax. If the inspector finds out you have no British claim open he should be able to email the CWO on your behalf stating there is no British claim open for your partner. You need to speak with a fraud inspector and not the usual inspectors (who interview customers for Jobseekers). Just a suggestion and there is no guarantee he will do this but it can be done!

    I didn't think your partner would be subject to HRC if tou are claiming for her as an adult dependent. Instead of going to CWO go to your own hatch and ask why is she?

    No your right she wouldnt but it still takes the same length of time wheather or which. She wanted her own claim with the social though. Pretty independant she is.
