    Here are the revised standard T & Cs for eirocm broadband.

    12 Month minimum contract , not 6

    Customer may not have eircom bb on a line rented from another carrier wholesale, you must go back to eircom.

    IF you bust your cap eircom can charge €2 a gigabyte up to a max DSL charge of €49.99 a month including the base package.

    If you bust you cap eircom can make you upgrade to a higher cap package instead of charging for use @ €2 a GB.

    If you refuse to upgrade ( Clause 5 actually says the cutomer who is "refusing or neglecting" to upgrade they can terminate the service .

    The upgrade will cost nothing bar the higher monthly charge.

    If you then try to downgrade they will charge you €25 inc vat

    EVEN if you do pay excess usage charges AND/OR accept an upgrade`you may still be exposed to the catchall clause 18

    "18 eircom reserves the right to impose limits without notice on a customer’s service, up to and including suspension, if eircom believes, in its reasonably based opinion, that a customer is using the service, including but not limited to excessive downloading unfairly impinges on the ability of other customers to avail of eircom’s services."

    This would allow them to boot you off if your IP address appears in spam zombie lists, fair enough to a point and especially if you refuse to clean the spamming software off your machine.
    But becuase they have defined this so widely they can kick customers off in areas where their network is overloaded thereby causing crosstalk, for example.

    In other words if you complain loudly about a cack service caused by crosstalk eircom can kick you off their network.
