Intellectual property law - fictional branding

    I searched this forum and couldn't find any mention of this.

    I'm just wondering if anyone versed in intellectual property law could explain to me the law surrounding fictional branding? I've tried researching it myself but it seems like one big grey area to me.

    By fictional branding I mean the likes of Weyland Yutani from the Alien franchise, InGen from Jurassic Park, etc. Sites like Last Exit To Nowhere sell merchandise with these fictional brands on them and don't get sued, while something like the australian Duff Beer would get sued.

    I suppose it depends on a lot of factors, but I'd really appreciate if someone could help me make sense of it all :)
