Data protection issue

    Folks,

    I'm an owner occupier of an apartment in the city centre. I have asked the managing agents for the name and apartment number of the other owner occupiers in the block. The managing agents have refused because of data protection.

    My argument that, as a owner occupier, I have a part share in the block and all data pertaining to it. The Managing Agents are simply that, managing agents on our behalf (through a nominated board of directors).

    Any opinions??

    Are the other owners members of the management company? If so you can get their details from the companies office.

    Reverse the scenario. How would you feel if the agents gave out your personal information to a third party without your consent? They are perfectly correct.

    I take your point Maximilian however the Agents are exactly that Agents, acting and engaged by me and the other owners of the block. Had we not chosen an agent, the information would be with one of us.

    As a shareholder you should be entitled to inspect the register of shareholders in the Management Company. Write to the secretary of the management company (not necessarily anything to do with the agents).

    I think it would be more correct to say they are engaged by the directors of the company and don't answer to you or any other member. As far as Data Protection goes I think they are right.

    That said, if I recall correctly you are entitled under the Companies Acts to a copy of register of members but I think you would have to write to the secretary of the management company, not the agents.
