legal costs query

    Hi all, i have a query re legal costs and i will just give u a little background to the issue (PS if anybody feels this post is inappropriate please delete) i am actually going to make an appointment with my solicitor for tomorrow but was just looking for some feedback from board members tonight if at all possible. s

    tory goes that hubby and myself purchased site 3 years ago - we built based on sellers engineers marking out of our site - never had any reason to doubt him - now we are going to fence in our site and got out own engineer to mark it out for us and it transpires that the original markings were way way out... we spoke to man we bought site from and despite us having our land registry maps as received from solicitor he is disputing the amount we bought off him - anyway to cut long story short lots of abusive phone calls (on sellers behalf) later we are going to have to take him to court to stop him moving our fences etc and to get what we legally own- my question is are we likely to have to pay all legal costs as we are the ones who will bring him to court or will all costs be awarded to us - i appreciate there may be no definitive answer but i would appreciate your opinions
