Text message - exclusion clause

    I'm struggling with a contract law question at the moment. I'm trying to find out whether a text message is an acceptable form of communication with which to incorporate an exclusion clause, i.e incorporation by notice.

    Any takers?

    It prob would fall within the definition of electronic communication in the E-Commerce Act 2000 so I don't see why it couldn't be validly incorporated.
