Money claim back

    Hello All!

    just wondering if i can claim my money back after i bought this crappy bike from the local bike shop, and i spent 350 euros on this bike and i had to bring it back3 times for fixing. Do i have the right to ask my money back i spent 400 euros together with the accessories ,and i am not happy at all. the bike is only 1 week old and its still without scratches or anything like that.

    What were the problems?

    €350 is relatively cheap for a new bike, and I guess you should not be surprised at having a few "teething problems". The shop should correct any defect, and if they have done so you probably have no come-back on them. If you complain hard enough you might get a bit of discount, but unless there is some fundamental flaw they are unlikely to offer you your money back

    Exactley what is wrong with it, whats the name of the bike and how did the problem occur.

    I doubt that you will get your money back, consumer law works both ways.

    bike is 7 days old or maybe 9 , its a merida branded bike cost 350 with accessories 400 ( lamps , vest , lock ) , the back wheel constantly get curved or i don't even know the word for that , its just not straight and gives a stupid noise bcs it has a fraction with the breaks , the first wheel is great back the back is the crappy one , i brought it back like 3 times the guy usually get some kinde special screwdriver and tries to adjust on those steel wires , but after 10 minutes use it just goes back again .

    exactly this is the one , i was at the shop today and i gave a complaint to the owner , he told me he is gonna fix it by tomorrow , but i don't believe that it can be fixed properly, i believe its a low quality wheel or its a bad construction.

    You wont get anywhere, thats considered wear and tear. Some people are very heavy on bikes, particularly the rear wheel, bashing it off kerbs, pot-holes etc. Wheels from a factory come fairly well tensioned, without being rude here my advice is to change your riding style, I wouldnt expect a e100 bikes wheels to buckle in 9 days.
    Also make sure your tyres are fully inflated to the reccomended pressure. around 80-100psi on those tyres.

    That bikes parts wouldnt be the best and at e350 it was a bit steep, perhaps you could use this to maybe get a upgrade on the wheels?

    What bike shop is it?

    I suppose truing a wheel in a few minutes is possible (I couldn't do it, but I'm not an expert) but it sounds more like the threading is gone on the spoke nipples. To be honest I'd ask for it to be respoked or replaced.

    Either way though I would have thought he'd have noticed if he's a good wheel man. Could be a cowboy and only really knows about horses :rolleyes:

    He should have a contact for Merida anyway, so I can't see it being a problem to get it replaced if it's in bad condition ie no cost to him.

    i dint miss use the bike , this is an urban bike i have used on the roads of dublin, i had to go back after the first day with the bike because i already had the problem after the first use, and i dont know too much about the wear and tear thing ,but i think it shouldn't have happened after the first use , i will tell the manager if i have to come back again i will want to send this bike back to merida , or i want to have my money to be refunded. and also the guy said there is a 1 year guarantee on it ,so i can come back anytime if i have a problem with it , and at the last time the shop assistant said this is the last time for fixing my bike wheel, i found this a bit dogy , i wouldn't come back 3 times if he would sell me a good product. anyhow thx for all the responses .

    Hell with him, time to kick up a fuss :D

    Joking aside he should have realised the wheel should have been replaced on the third occasion. If it goes again, I'd go for a refund. If he's not budging ask for the manager, put it in writing, impersonal, and state all the facts including his comment about not fixing it again. Then go for a consumer rights agency if he still won't budge.

    If you have go through a consumer rights agency, the implication of bad press (on boards) maybe useful, not that I would condone that sort of thing.That guy from student bikes suffered pretty badly from it if you look up that post ;)

    In fairness it's not "wear and tear" if the rear has gone out of true 3 times in the first week since he bought the bike. It is a problem back wheel. To be honest if it has happened 3 times he should be replacing or rebuilding it.

    @CramCycle- it is possible to retrue a wheel in a matter of minutes if you know what you are doing, I have seen other people do it (not me :) )

    Gimme that bike for 10 mins and I'll do a pretty good wear and tear job on it;). Ramming the wheel up and down kerbs will buckle it easily.

    The fact that it has been fixed 3 times would suggest that its long past a manufacturing fault.

    1 Year guarantee doesnt mean that you can get everything that goes wrong fixed for free, Id suggest you read the details of the warranty, you will be suprised.

    While it shouldnt buckle after 9 days, the bike shop are doing their best. Even Shimano R500 wheelset is ****e and does a similar thing very quickley for certain riders(usually 12 stone +). I wouldnt go in shouting consumer law, it just weakens your position.

    I'm with blorg on this one. Any wheel that goes out of true three times in a week, including the first day out is not fit for the purpose it was sold and I'd either pursue a replacement and refund.

    For what it's worth, a lot of shops don't seem to be great at truing wheels. Any shop I've brought wheels into never did a great job.

    Anytime I true my own wheels, they stay straight for a decent amount of time, its very very very hard to get a bent wheel back to 100% you can get 98% but perfect is impossible IMO.

    Wheels dont just buckle to be fair.
