How much notice to we need to give

    Hi all, due to reasons beyond our control, we need to move from our rented apartment asap, we signed a one year contract in 2006 and nothing since, i rang this morning and asked could i give 2 weeks notice and i was told i need to give a months notice, is this correct as my contract expired in 2007.

    Yea you have to give 28 days at least. Given the length of time you have been they could actually request more. Read the above

    Does that not count for a fixed term tenancy, i may be wrong, our 1 year expired in 2007

    I don't see why the fact that you aren't in a fixed lease should preclude you from giving at least 28 days notice tbh. That seems to be the minimum.

    Thats what im trying to find out, we have no contract now

    If your there more than 2 years the tenant is obliged to give 56 days notice.

    Read the PDF linked to earlier, if your original lease ended in 2007 you've started a part 4 tenancy since then and it's been over 2 years since that happened, so you've to give 56 days notice.
    Since they don't seem to know this, give them the 28 days they asked for and get the hell out :)

    minimum notice is 28 days regardless.
    turn the situation around and ask urself how many days notice would u like if he wanted you out of the house if u didnt wanna leave.
    if i were you id play the 28 day card and if that works ,RUN
