"Estate taken into charge" question

    As I understand it until a housing estate is "taken into charge" by the council/corporation the developer is in charge of maintenance. If the developer is unwilling to perform maintenance what options are there? Who can force the developer to take appropriate action?

    Only if the developer is still in control of the Management Company. If all the. units are sold then the owners are in control of the MC which is responsible for maintenance etc.

    Even if there is no management company, the developer is generally responsible for maintenance, since they would have owned the land the houses were developed on. We're running into a similar situation in our own area, the council won't take over until the original estate snag list is sorted out. Until then we have the odd community cleanup day where everyone goes out with bags (supplied by the council). We are considering various means to force the developer to live up to their responsibilities in the interim.
