    I don't think you do, as far as I know you only have to resit the test if you get 12 points and license revoked, drink driving is usually just a temporary ban.

    You could introduce the death penalty for DUI and people would still do it - the only solution is a real chance of getting caught.

    You're assuming (incorrectly IMO) that drink-drivers are rational decision makers.

    Is it not at the descretion of the judge? Judge will order a resit of the driving test or not, depending on circumstances?

    Fair point, but I suppose the way I'm thinking is that they wouldn't make the decision to take the car to the pub sober if they were aware of how serious it would be if they were caught.

    Would still leave the people who have a skinful at home THEN decide to take the car, as well as those that had every intention of leaving the car at the pub until the tenth pint, etc.

    I'd be surprised if most drink driving cases were people coming home from the pub these days. The one lad I know well that got done was a morning after jobbie for instance.

    i was just talking about this with a friend. i would love to see some stats on how many people are caught after coming straight from the pub rather than having 8 hours sleep

    Yeah I suppose so. In this situation you have people who are no longer drunk, but are severely hungover, ie: still under the influence of drink in some shape or form. Problem with this one is that it's a lot harder for the person to gauge imo.

    It's within their ambit alright, but very rarely done.
