Package gone missing in post

    I bought a camera of a good seller on ebay and it was dispatched 3 weeks ago. It hasn't arrived yet and im pretty sure its not coming now...the seller put my address on the package but never included "Dublin" or the post code.

    Its coming from the UK and both I and the seller are pretty sure its lost.

    Now i'm going on a once in a lifetime holiday in 2 weeks and need a good camera...i cant wait for him to settle this dispute etc with Royal Rail as it could take another 2 weeks. So i need the money refunded asap so i can buy another one, but hes not going to do this until the case is settled with Royal mail.

    So what do i do here, do i risk buying another camera and hope the original one doesnt turn up in the post? And could the original seller take it back seeing as it took so long to deliver?

    I cant buy this type of camera in a shop over here, so i cant wait another 2 weeks and if it doesn't show up and buy go and buy it in a shop here.

    Any ideas on how i should proceed?

    Its all pissing me off a bit.

    It's the sellers problem. If you paid with Paypal, then start a dispute and escalate to a claim. You don't have to wait for the seller to claim back on his insurance, as you effectively have insurance with him yourself. He is the responsible party for the delivery to you, not Royal Mail or anyone else.

    Thanks for clearing that up. Ive waited 3 weeks at this stage, should he refund at this stage?

    As i said...im in a major hurry seeing as im going away in 2 weeks and need a camera, is it reasonable for me to buy another one now...and if the origianl one turns up to send it back?

    Im pretty new to ebay so wanna be sure before i do anything

    Don't get all tied up with exclusion clauses that the seller might have put in the auction listing, some say "if you don't buy insurance and the item is lost its not my problem" as its not true.

    As Jor el says open a dispute, all PayPal will be interested in is if the seller has proof of delivery. No proof of delivery you win the claim. Just beware of the time limits for raising a dispute as its common for sellers to playfor time and leave you with no redress.

    I'd agree with both reply's above, when a seller is registered with Pay pal/E.bay their record must very good to excellent and must abide by their rules and regulations.
    So make your complaint to E.Bay Pay Pal and seller, then go on holidays and buy a new camera and when you come back it should be all sorted. E.Bay and Pay Pal are there to make sure your not loosing out, if the seller didn't address your product properly it's not your problem.

    Do you have a tracking number for the package?

    If the item was posted as a parcel in the UK, "international Standard", "EURO 48",it is 99% sure that GLS are the company in Ireland that will deliver it.

    If it was sent by "AIRSURE" or "Signed For" it is probable that An POst have it.

    Ring customer services in AN POST with the tracking number and even if it not addressed correctly, they can find it or tell you that it was not with them for delivery.

    Sorry that might not be the wisest course of action. All the OP can do is raise a dispute with PayPal, that is a two sided afair where both the seller and the buyer are expected to respond so if the buyer goes on holiday before its all resloved there's a chance the seller will get out of a refund. All the OP needs to do though is check his email or have someone do it for him and respond with any info PayPal request. Having said that PayPal should sort it in 2 weeks.

    He never got a tracking number, so I don’t know how he sent it and I can't track it. He hasn’t replied to my most recent correspondence asking that very question, which I sent 3 days ago. I just want the camera now and don’t want all this hassle, but I've gone ahead and opened a dispute through paypal.

    I'm fairly confident he'll refund me if it doesn’t show up, but I'm trying to decide if I'll buy another one from ebay (the only place this particular model) and just hope that the original doesn’t turn up now, otherwise I'm stuck with 2!

    Yep, its a panasonic TZ5 which has now been discontinued.
    The going rate for a second hand one is 140+ on ebay, amazon/piximania etc have then for 230+, so quite a difference especially when im trying to keep cash for travelling.

    Exactly. Had this exact issue this week. The buyer couldnt provide a tracking number and as soon as it went from a dispute to a claim they ruled in my favour and I got my money back.

    Its a while since I opened a dispute, how long is it before you can open one and how soon before it becomes a claim?

    I think you can start a dispute more or less straight away. The seller then has a chance to respond to the dispute, if you the buyer are not happy with the response you can escelate it to a claim. In my case they then emailed the seller for tracking info. Then you review the tracking info the seller has posted. You have the choice then of cancelling the claim or if you have not cancelled it within 2 days they will continue the investigation. Again in my case the seller provided an invalid tracking number and once the 2 days was up they emailed me to say they found in my favour and refunded the money.

    Just a point on the PAYPAL Purchase Protection !

    Be aware that the protection only covers certain countries (UK is included).

    I purchases a car part from Germany which never arrived, I reported it to Paypal only to be informed that the cover does not extend to Germany and Ebay has different rules in different countries.

    Read the small print I guess !
