Harrasment by eircom winback employees

    I have been getting many visits from eircom employees looking for me to sign up to eircom. I have told several of them to go away and not to return. Despite this they keep coming back and pestering me.

    Is there anything I can do to get rid of them for good?

    This is very interesting. Indeed there are many things you can do to get rid of them. I would start by getting their names and reporting them to ComReg.

    Calling your phone or in person knocking?
    Is it general eircom products or eircom phone watch? The latter is run by a 3rd party company

    These are selling eircom products i.e. winback agents. They are calling to the door.

    Hi OP,

    I would be of the opinion that this is an Aggressive Commercial Practice as set out by the Consumer Protection Act 2007 given the location (your home) and the persistence of the visits.

    Also under S. 55(3)(b) of the Act - A trader shall not engage in any of the following commercial practices: (b) failing to comply with a consumer’s request to leave the consumer’s residence or to not return (except in circumstances and to the extent justified or permitted by or under law in order to enforce a contractual obligation).

    The remedies available include obtaining a prohibition on them carrying out such practices from the Circuit Court or High Court under S.71, and you may also try for damages under S. 74, but it would be far simpler (and cheaper!) to complain to the National Consumer Agency along with Comreg.
