    Hi there,

So you have emailed both sellers and neither of them have replied?

In the case of the pen drive you can file a SNAD (Significantly Not as Described) with Paypal. You will need to explain that the drive is faulty.

In the case of the top you can file a NR (non receipt) claim again with Paypal.
It shouldn't take 5 weeks for a top to arrive from the UK. Chances are the seller is out of stock or is using a dropshipper.

Apart from that you just have to wait. Paypal will email you if they need any more info.
In the future check the sellers feedback. This seller has a lot of negative feedback considering the amount of sales also the seller is using a dropshipper which brings its own set of problems.

Edit: Also if you have a closer look at the feedback you will see other buyers complaining that the drive did not work

    NEW! 64GB 2.0 Flash Memory Stick - 64GB Memory (#270510139735)

In the case of the memory stick, it's probably a 32GB or 16GB stick that's been flashed so it appears as 64GB. This results in corrupted data, and is common on larger memory sticks sold on eBay. The seller has nothing for sale right now, and looks like he's stopped replying to others too. My guess is he's cleared his account and done a runner. If that's the case, you won't get a refund, but you should start a dispute and escalate to a claim immediately anyway.

You bought the drive on the 5th of January you can still start a claim and should do asap.

You must open a case within 45 days of the end of the listing.

Sorry OP looks like it. I think you can still open a dispute with the seller but you wont be able to escalate it to a claim.

I think Jor el was being a bit optomistic there, I've looked at a few of these 64GB keys and they are mostly 2GB and 4GB keys with a bit of reprogramming to report that they are 64GB in size.

btw I'd be supprised if many/any of the 64GB keys on eBay are genuine and the one you bought was an obvious fake which might only be a 128MB.

Get a program to test the capacity here and let us know how big it really is. This has a bit more info on fakes and here's another USB test prog.

I've not tried it but RMPrepUSB (link not working atm but afaik it is correct) sounds like what you need to get full use out of whatever capacity drive you actually bought.

Edit> Just noticed this scary bit of feedback for the Chinese USB scammer ....

Item arrived as described. Comm could be better...but the rest was 5 stars!! paulolemos_12 ( 22) 31-Jan-10 03:00

Could have been a lot worse though. You know what not to do now too, so not a complete waste.

    Thanks for the reply.

If Paypal don't help and you paid through Paypal using your credit card then you can contact your bank and explain the situation to them. They may do a chargeback.

I used to buy of eBay a lot. On one occasion in a dispute Paypal sent me a mail saying that they accepted that the seller was at fault but could only refund me 30% of the cost as that was all the seller had in his account. I contacted my bank and sent them on the details requested and they refunded me the rest after a few weeks.

So if you pay through Paypal set it up to take the money from your credit card. That way if you have a problem you're protected by whatever Paypal will do and if that's not satisfactory then by whatever your bank will do. Save all correspondance with the seller and with Paypal. I've only ever had to do a couple of chargebacks and it's no hassle once you document everything.
