Car Crash

    I was just wonderin, a few weeks ago someone crashed into my car and promised to pay the damage. I wrote down her full address, phone number, email address and car reg number. I forgot to take any pictures, didnt have garda involved and also didnt take her license number. As it has turned out the car wasnt even on her name and she doesnt wanna pay up and she has no insurance. How should i go about it?

    Go straight to the Garda, bringing your solicitor if you want.

    ya but i have no proof that she crashed into my car? i meqan i didnt get a garda report or a picture? Would that not make a difference?

    Garda do not attend most 'minor' accidents.

    As suggested earlier, report it to the Garda now on the basis you have found out the vehicle (or driver) is uninsured.

    If the vehicle is insured, regardless of whether she is insured to drive you will be able to recover damages fromt the insurer of the vehicle.

    If vehicle is not insured, claim against MIBI it will cost you €440 (excess) and if you have comprehensive insurance they will direct you back to your own insurer anyhow.

    At the moment other driver is not denying being involved in a collision with you so just proceed on the basis it will not be disputed. If she does dispute then the explanation of how you came to have her Email and telephone numbers will be interesting.

    Typically Gardai don't investigate traffic collisions unless there is serious injury or death. Its the insurance companies that investigate minor crashes.

    Guards if called can be there more so to ensure that names addresses and insurance particulars are exchanged (and check insurance etc).

    Has it been over a month since the crash? How do you know she has no insurance? Where you both alone? (did anyone else see it happen?)

    Well its been nearly a month ana half now. it happened on the 21. january. She said she doesnt wanna go thru insurance cause the car is not on her name and she is not insured on it. i was with my partner and her car was full but i dont know who were the people in her car.
