    Beats the crap outta me too, but sure she probably came from a disadvantaged background, failed social system, fell through the safety nets, history of drug abuse, parents marriage failed etc, etc, e-fucking-tc.

    I am not aware of the facts why this guy was not charged with murder - according to the news last night, the manslaughter verdict was carried by a 10 to 2 jury decision so maybe the evidence was not 100%.

    Am I missing something? Does the report I linked not say he was found guilty of murder?

    I would really like to know who the two on that jury were who didn't accept
    that this was murder. WTF?

    You are right, I missed the news so was listening to the radio, must have missed the murder conviction. But as far as I remember the jury was 10 - 2, I will check it when I get the chance.

    Difference between manslaughter and murder is that for murder you have to prove intent - i.e. what someone was thinking at a given moment. That basically means you have to prove it was pre-planned. Heat of the moment stuff generally results in manslaughter convictions. Unless, of course, you shoot a knacker in Mayo, but that's different! ;)

    Whatever about the official and technical differences between Manslaughter and Murder, the reality seems to be whatever Red Herring the defendant comes up with, including the lame, "I didn't mean it.":rolleyes:

    That basically means you have to prove it was pre-planned.

    As far as I know premeditation is what distinguishes first from second degree murder. Manslaughter is pretty much "I didn't mean it" while negligent manslaughter is "I didn't mean to kill him, but I wasn't really bothered".
