Renting problems.

    Hi there!

    How are you going?

    We are a couple who rented an apartment to ***an agency*** and we were living there for almost 6 months when deciding to move. As our contract said, we gave the agency one month noticed in advanced and everything was in good condition so the agency gave us the deposit back.

    But, we had paid for the whole month and left it on 20th so we asked for the rest of the month we haven't lived there.

    At first, they told us we'd have been paid shortly, in fact, with the deposit. As it wasn't true, we claimed and they said it was a decision of our landlord but not of them.

    Now, it's two months since we left the apartment and neither our emails nor our calls are replied.

    PRTB has said to us they can't give legal advise.

    Does anyone know what we can do?

    So you got your deposit back but you paid 10days too much rent on the apartment?

    Was your rent 'per calendar month'? If so then you've to pay the whole month and not part thereof.

    Eg. At beginning of jan you give months notice and pay your rent for jan then you are entitled to your deposit back at beginning of feb but if you move into somewhere earlier, ie. 20th jan, the landlord is entitled to keep the remaining part months rent as per the contract. Sounds like everything is above board.

    We paid the whole month at the beginning but we have told them we were to move on 22th. So, the last day for us in that apartment was supposed to be the 20th. But, at the beginning of this month, we had to pay the whole of it, even though they know we would leave.

    So, our contrat finished on 20th and we had paid for 30 days. So, what about the rest of the money? When entering, we had to pay for each day until the first day of the next month. For us, now it's the opposite.

    Hope now it's more clear.

    im not sure why you just didnt insist on paying for 20 days instead of a full month at the begining of the last month.

    you should get the money back. if the prtb wont open a case what about
    the small claim court?

    Where's the 22nd coming from? If you gave your notice a month in advance and said you'll be out by the 22nd then you've to pay up until then regardless of what date you actually moved out.

    If you paid 8 days extra and want it back and your lease doesnt specify that the rent is per calendar month then fill out a prtb form and send it off. It will take months to process even after you get a hearing.

    Totally agree with you. We should insist on that but we didn't realize this could happen. We hadn't had any problems with this agency and for sure not with anyone in this way in other places and countries.

    Thanks for your advice. We are moving in one month to another country so we're thinking in something quicker than the court. Anyway, that's a possibility and maybe the only way.

    Sorry, haha, I hadn't described it properly. Anyway, you have understood the problem and it's not about the exactly day we were out but about the days we paid extra.

    Thanks for the advice, as I have just said to another mate, we're about to move to another country and we were wondering about something quicker.

    I'm afraid the only way to get a quick response is through the letting agent then. All other procedures take time.

    Good luck getting it back and with the move.

    6 months lease - 6 months rent paid. End of story I would have thought - they did not make you move out a few days early. Forget about getting any cash back.

    The court will send you to the PRTB.

    The PRTB didn't say they wouldn't open a case, they said they couldn't give legal advice.
