The website http://injuriesboard.ie contains extensive information on how to make a claim and a guide to the process http://www.injuriesboard.ie/eng/Forms_and_Publications/Guidelines/Claimant_Guide.pdf .

The Board also has a Service Centre which is open 8am to 8pm at lo call 1890 829 121.

Once the Board has received your completed Application, it will then inform the person you hold responsible for your injury (that’s the Respondent) of your claim against them. The Respondent has 90 days to confirm whether or not they agree to the Board making an assessment of your claim.

If that consent is received the Board must make its assessment within 9 months. However, at the moment assessments are taking 6/7 months on average.

Thats Great thanks for your help, my sister made a claim with her solicitor and she recieved a letter from the personal injuries board on 30th of november just to say they had got her medical report etc on the 23rd of nov, but she has heard no more on the matter should the personal injuries board have notified her if they are able to make the assetment or not by now?

It is not clear what stage your sister's claim is at, so it is not possible to comment on that case.

In general, when the Board has a competed application ie all the necessary information has been provided, a Notice goes to the Respondent and they have 90 days to reply. http://www.injuriesboard.ie/eng/FAQ/#8

It is 90 days from the date that the Injuries Board write to the Respondent. So your sister's claim was registered on the 30th November but the Injuries Board may not have written to the Respondent until say the 20th December or 18th January 2010 (these dates are just examples) and it would be from that date that the 90 days starts to run. Either way when the Respondent either declines or accepts the Injuries Board's jurisdiction it can take between 6 months to a year for an Assessment to be made.

My brother's car was hit from behind by a car also, he has submitted the reports to injury board, he has considerable back pain and reports from doctors. The lady was driving a rental car and was living in Holland. She was not convicted of anything so what will happen and how can this be claimed. How far does the personal injuries jurisdiction extend.

I'm pretty sure she is covered under the car rental company's insurance. If he got the insurance details, then he should go through that insurance company

He was told that the driver was not listed on the insured drivers of the car. Dont know if that makes any difference to him. They insurance company say they will try to chase her via PIAB; which has been now running for a while. Are they able to enforce all this in Holland is the worry.

That is the insurance company's problem. They are obliged to pay up if they had a policy of insurance on the vehicle.
