Car Insurance And Accident

    Hi

My aunt was involved in an accident where an individual came out of a 2nd road and hit her. The Gardai were called and advised that the other party was in the wrong and that the individual involved had called his father who lived locally and was very aggressive and was blaming my aunt.

We contacted out insurance company and they advised that the other party was liable.

We swopped telephone nos and the day after the guys father called me and asked we deal with it ourselves and how was my aunt etc. He wanted us to settle our own damages. I advied that we were better letting insurance companies deal with it.

Now 3 weeks have gone by and a week ago the other parties insurance company advised that there client would be liable unless he could provide new evidence is provided to the contrary and would write to him and give me 1 week to reply.

She has not had to hire a car as we had a spare car and gave her this.

This week has now passed and they are awaiting assessors report today to settle this.

She has not had to hire a car as we had a spare car and gave her this.

What I would like to know is

1 How do insurance company decide on value of car
2 The insurance company said re car hire
"I am sure that you can understand that we were unable to provide your aunt with car hire as we were not in a position to accept liability, this being the reason that we did not contact her to offer same."

What I understand from this is because their client would not accept liabilty my aunt was not entitled to a hire car? This does not make sense

3 Can we get reimbersed for:

a Car storage 15/day by garage. Total 375

b Car hire starting from today at 35/day.

c Towing of car to garage 150.

d Estimate of repair by garage 150.

    Many thanks,
    Noel

Why would you get reimbursed for car hire if your aunt is not hiring a car? The garage should assess how much it will cost to repair the damage and create an estimate for the insurance company. They will send out an assessor anyway to decide how much it should be. If the damage to the car is more than the it's value, it will probably be a write off.

    Thanks for reply

I asked the other parties insurance company would they pay for a hire car after accident they said no until liability was resolved. They were waiting for there client to admit liability so my aunt could not hire a car as she did not want to have to pay for it if the insurance company would not.

The car is worth 5k we think and damage is 3.5 so will be written off but we are totally at the mercy of what value we are offered for car? If we say no all the insurance company will do is not pay. Is there any leverage we can use to get a fair value for my aunts car

Well, they will normally go by how much similar cars are selling for but you can argue with the insurance company how much it is worth. If the damage is 3.5k, then they will probably repair it unless there is some safety issue with putting the car back on the road after being repaired. It depends where the damage to the car is.

Why is the client not accepting liability? The guard explained on the day that it was their fault. Did he write a report or anything? There should be no issue with liability if the other driver accepted it on the day. I'm not familiar with how it would work in this case. Did your aunt take any photos or anything as proof? I'm guessing it will just be sorted out between the insurance companies.

dont know why hes not accepting liability . There should not be an issue with liability but insurance company gave him an extended period before they would take over and admit liability. No idea on report but the other parties insurace admitted liability readily but would not move on payment until client has accepted liability or until he had 7 days in notice that they were going to settle

Assessor told me car will be written off
