Fixed Charge Offence - Details Incorrect.

    Hi There,

    Anyone ever get a fixed charge offense letter with incorrect details?

    I have received one for an minor offense i committed but it has my surname spelt incorrectly. One letter is incorrect.

    Should i send it back to sender with a note saying not at this address. :D

    I would doubt that trying to get away on a minor typo will do you any favours with the Gardaí or the courts system. They might even throw in an "attempt to pervert the course of justice" charge too, if you sent the summons back. If you want legal advice, you should really go to a solicitor, not a motoring sub-forum.

    This happened with me when I got points years ago. Surname spellt wrong - I got my wife to ring the Garda who issued the points to ask what the situation was (she works for a solicitors).

    I was told I can not pay the fine and take it to court if I wish - but that the Garda can apply to have the details on the original fine changed on the day. In other words, your details will be spot on by the time you face a judge, and you'll be left with double the points in all likelihood.

    The date or townland needs to be wrong to get it thrown out. As kdevitt said they'll just get the details changed for something like name spelled wrong.
