Adoption Laws

    Folks,
    Was just looking over some different law related exam paper questions given to students. The questions are given to courses in childcare who study a law module. I have no copy of the course content as I am not sitting any such course, but have an interest in law so decided to have a look at them. I thought the questions were tough enough for non law studying students, but I guess in the area of childcare its needed.

    Anywhome, I see that Ireland have not ratified the Hague Convention but are a signator - what exactly is the impact of this? I would have assumed its just Ireland saying "We support it, but its not in practice here yet" which means we have our own set of ways dealing with overseas adoption.

    Also, is Vietnam part of the list of country's where we have an agreement with for inter-country adoption? The Adoption Board website seems to have been hacked and when I moved through it there was no information on it. The Hearld has an article from 2008 which suggested there was a possibility that this may fall apart in the new adoption bill but I cant see the outcome.

    I'm not sure the ramifications of signing but leaving a convention unratified, but usually signing indicates intent to ratify and in fact that seems to be exactly what's happening. The Adoption Bill going through the Oireachtas at the moment will allow Ireland to ratify.

    It used to be, but intercountry adoptions from Vietnam were suspended following publication of a Unicef report late last year which showed severe irregularities in Vietnam's handling of the adoption process. Most significantly, it demonstrated that foreign adoptions from Vietnam are demand-led rather than supply-led - meaning that the more foreign couples want to adopt Vietnamese children, the more "adoptable" children magically appear. This is not the way it's supposed to work.

    So if the adoption board refused the child legal status - what would the impact be? I assume its just a matter of they cant get legal status a normal child to the family would or does it have much more severe consequences?

    Also, when Ireland ratify the convention I assume its just a matter of stricter procedures when allowing inter-country adoption? So if I was to adopt a child in another country which do not have the same procedures, I assume you just would not be allowed to adopt the child? Also, if the foreign country did ratify the treaty - what would the impact be? Again, I assume it just means a more straightforward adoption?

    Where does one lookup the Adoption Bill?
