Faulty Ipod touch - What to do?

Hi, I currently have a problem with my ipod that I need to get sorted - The sound doesent work properly (the left ear seems to always come and go). I thought it was just my earphones but after buying countless pairs of them I think the fault lies with my ipod itself  I only bought a new pair today and already the sound has gone wonky in one ear.

So I was wondering what to do? Will I bring it back to the place of purchase? (Spectra Photo near Grafton St.) I still have the receipt from when I bought it (8/11/08) I just dont know whether or not im able to bring it back or not since its been more than a year  But surely to god paying 280e for something and It being faulty a year and a bit later should go in my favour...

Or would I have to ring up apple and request for it to be repaired? (If so how much would this cost?)

Try use a paper clip carefully into the headphone socket - your problem may be just fluff etc jamming up the socket
