Childcare/Preschool Regulations 2006

    I am interested in knowing if leaving a young person in first job and with a Fetac Level 5 qualification alone in a creche with 5 children without contact details for an adult who could be called in to help cope with an emergency is kosher? The regulations suggest it is not.

    Can anyone clarify if Child Care (Pre-School Services) (No 2) Regulations 2006 and Child Care (Pre-School Services) (No 2) (Amendment) Regulations 2006 are really regulations or merely guidelines/suggestions which do not have to be followed by creche/preschool owners/managers or enforced by preschool inspectors.

    Would appreciate replies.

    Answer second question first: The answer is in the title, Regulations.

    Your first question: It doesn't matter if it's the persons first job. She has her FETAC Level 5, she's qualified to be doing what she's doing.

    She was with 5 children. Well unless the children were under 1 year of age then the ratio of 1:5 is acceptable.

    Are you saying that the contact details were not in place for a parent of a child or that there were no emergency contact details for a second staff member to be called upon?

    I will assume the the girl in question is not the owner of the creche? If she was left alone then one question to ask is is she a qualified first aider? The regulations state that there must be a person trained in first aid for children on the premises at all times. (Reg 6, FIRST AID, page 36 of the .pdf document) So if she's not a qualified first aider for children then the creche would be in breach of regulations.

    Under Reg 8, Management and Staffing it states that a second adult must be available to cope with emergencies. So if there wasn't a second adult on the premises than it would suggest that the creche was in breach of regulations as even childminders in there own home must a) have a phone and b) a second person available to cope with emergencies.

    If you are a parent who has a child attending this creche ask for a copy of their policies and procedures and compare them to the 2006 regulations.
