Hi, I put a deposit on a car today. I went n done the online check... outstanding finance. Called the guy and he said it could be that it hasnt been rectified yet and he will sort it tomorrow??? How plausable is this. I got a receipt so hopefully if all fails ill get my 500 back!

What you think??? run a mile or are there any logical reasons???

I assume it's a private seller you're talking about OP? Either way I'd be very wary. Find out all the concrete details once he's spoken to you again. If things are still a bit cloudy I'd get worried, but I wouldn't panic just yet as admin errors can sometimes occur.

Did the exact same as you today- put 500 deposit down then went home and did the check. But mine was fine. Defo get onto them about it. Hold onto your receipt also. You're entitled to it back

Not many people can afford to pay off finance due on a car before they sell it. I had to sell a car before and pay off the finance outstanding out of the proceeds. But that was in the days before the online checks.....

Right so it could be LEGAL? so if the person didnt pay the car off then mine would be reposesed???

The online check was on motorcheck.ie and it cost 50 squids.. worth it just in case

If you buy it and he decides ah i wont pay it off after all- you lose the car- very harsh but thats the hp laws! Insist on full details or demand deposit back. Deposit was put in good faith, details of vehicle were undisclosed, threaten with gardai as a last resort. Don't be soft!

What you need is a letter posted to you directly from the Finance Company to say

"We have no further financial interest in that vehicle"

I was caught up in this recently myself as a seller and got in a lot of trouble. The letter is what you need, trust me from experience.

Same thing happened to me 2 years ago when I bought the Accord, found out there was finance outstanding. So I got a letter from the bank and I phoned the bank to confirm there was no finance outstanding.

I had the same circumstance a couple of months ago. The car was from a dealer on the Naas road. I put a 500e deposit down, went home, did a Cartell report which told me finance was outstanding. Rang the dealer who told me that that was "impossible". Rang Cartell who got onto the finance company, then rang me and confirmed that finance was indeed outstanding. Spoke to the dealer 3 times after that - each time he blatantly lied about the ourstanding finance.

Eventually I went down there, and thrust the Cartell report into his face. Even then he wouldn't give me my deposit back until I told him I was going to stand on his forecourt and tell anyone who came within 6 feet of the place that he was not to be trusted (although I fear that my language was not as polite)

May not be that big a deal. I bought in Jan and the check said finance outstanding. Rang the garage and asked them to double check it. Turn out was just an paperwork error, the guy who sold the car to the garage transferred the finance to the new car and finance co hadn't updated the reg on whatever system they were supposed to.

It also happened to me when I bought one car on finance but the garage never cleared the other car on finance. It was quite a while before I noticed. The Garage refunded all my payments once they paid off the other finance company. It was like having a private savings account I never knew I had.

On how I didn't know I was paying for two cars and only having one......................that's a conversation for another day.
