Employment Appeals Tribunal Witnesses

    My case is coming up soon so I am preparing.

    I need to call up about 7 witness from my former employers.

    Can anyone tell me:

    1. If I call up another former employee of the company as a witness. can they refuse to come?

    2. I need to call up the Managing Director of the company but she not based in Ireland. Can she refuse to come?

    3. Is there any limit on the number of witnesses that can be called up?

    The company is legally required to supply a representative of the company you worked for, this can be either a legal representative or a senior manager, someone who was more senior to you. As regards witnesses, there is no set amount, one or more would do, however the more the better, this said, they must be impartial, for example not relatives and most importantly they must have worked directly with you, same department or closely. I am assuming a rights commissioner is hearing your appeal?

    Its very important you have all the facts to hand, Payslips, contracts of employment and any written communications regarding disciplinary matters if any exist. These cases very much depend on the nature of the dispute, unfair dismissal, constructive dismissal etc. What is key is having all the facts to hand!
