Insurance Claim Advice Required

    Hi,

    Last week I was driving along a main road when another driver reversed out of a parking space and backed into the side of my vehicle. His insurance company has said that they will be paying up without quibble as he was in the wrong which is great.

    However, while we originally thought that it was only the side and rear corner of my vehicle that was damaged I have now noticed that the front corner of my vehicle has been scratched as well as it must have glanced off his car when driving past him. The rest of the front and side of my vehicle is perfect until about half way back where the serious damage occured.

    What I want to know is should I point the damage at the front corner out to his insurance company/assessor or should I keep quiet and just get the rest repaired?

    If I point out the front corner is it possible that they will then say that I drove into him and possibly get out of paying for the damage to my vehicle?

    Any help/opinions appreciated.

    The insurance company has admitted liability...so you should be safe enough...

    i will say it might look like you trying to get extra repairs done that wherent a result of accident...
    more than likely if you glanced him as you said while driving by the start of the scratches would be a the front and would run continiously down the side of the car...

    are you sure they where caused by this accident? if you are then you are entitled to have them repaired, if you not... then don't claim... as that could be seen in some eyes as fraud...

    Thanks for your help.

    I would also have expected the scratch to be continuous but it is not.

    They are definitly as a result of the accident. The vehicle is a Land Cruiser and is quite wide at the front.

    The only thing that I am fearful of about bringing it up is that they might say that I drove into him and that it was my fault when it is not. I am not familiar with who is deemed to be right/wrong in cases like this so do not want to be putting myself in a disadvantageous position.

    Your settlement cheque will more than cover the repairs anyway I would have thought unless its one of those insurers who will only issue the cheque direct to repairer.

    if he was reversing out its his fault either way

    tell them the worst that can happen is the engineer says its from a different crash

    you can claim for this damage the third party reversed out in front of you, you are not at fault and entitled to have your vehicle repaired to its condition prior to the accident

    The onus is on you to prove that this damage was as a result of the same accident. If you can, then there is no problem as they have admitted liability. It is not up to the TP insurers to prove it was not part of the same incident

    There's every chance there will be some paint from the 3rd party's car in the scratch.
