Management Company - Damage

    Hi All

    Residential Apartment - Underground secure car-park.

    Arrived down to my vehicle this morning to find some one had reversed into my front bonnet creasing and pushing in the bonnet. The damage meant that the grill fell out and the perpetrator subsequently took this grill and left the scene.

    This incident occurred during the hours of 8PM to 8AM. I have reported the incident to the local Garda station and gotten in touch to the management company in relation to any CCTV that may be available. But judging from camera position and location it doesn't look promising.

    Any opinions on my position in relation to pursuing the management company for the costs of repair as It looks as if its a dead end unless the perpetrator gains a swift conscience. The car park is residents only with a security barrier which is radio controlled by key fob.


    I am pretty annoyed at this point and can ill afford to fork out for a new bonnet as It looks creased beyond easy repair. :(


    Any help or opinion is much appreciated.

    Why would the management company be liable for this damage? Surely a resident of the apartment block who is authorised to park there could have caused this damage.

    My point is what could the management company have done to prevent this that makes them negligent?

    I am not gunning for the management company in any case, My goal would be to find out who has caused the damage. As stated above. However surely the management company have some form of insurance if such an incident arises. Believe me if i could get the perpetrator I would, but if this fails do i have any other recourse avenues that i may consider.

    (It is obviously a resident as the keyfob system is how you gain access.)

    Believe me that I am sympathetic to what happened to you as it happened to me last year but I am trying to highlight that you don't have any case against the management company.

    It is very possible that you could see from the CCTV someone walking towards their car and then a delay where they hit you car and took the grill. At least you might be able to get the number plate and see the damage on their car and then bluff that you have evidence and that you want the damage paid for. I hate a$$holes that do this type of thing to people and disappear afterwards without taking responsibilty.

    Talk to you solicitor,

    who will tell you your management company is not liable to you unless you can prove they were negligent or breached a term of your lease with them
