Should Willie O Dea face criminal prosecution?

    There is a prima facie case to be made out that Willie O Dea has broken the law in making a statutory decleration to the High Court which later turned out to be false. Should Mr O Dea now face criminal investigation and prosecution over the said allegation? Green Dublin City Council candidate Gary Fitzgerald yesterday lodged an official complaint with gardai over alleged of wrongful statutory decleration by Mr O'Dea. I understand that Mr Fitzgerald a barrister refers to it a perjury.

    I understand this comes under the Defamation Act 2009 rather than the Statutory Decleration Act 1938 which follows

    S(7) A person guilty of an offence under this section shall be
    liable—
    (a) on summary conviction, to a fine not exceeding \3,000, or
    imprisonment for a term not exceeding 6 months or to
    both, or
    (b) on conviction on indictment, to a fine not exceeding
    \50,000, or imprisonment for a term not exceeding 5
    years, or to both.

    S(8) An affidavit sworn under this section shall include a statement
    by the deponent that he or she is aware that the making of a statement
    by him or her in the affidavit that is false or misleading in any
    material respect and that he or she knows to be false or misleading
