would a judge treat a knacker different than an ordinary being....

    say some scum bag breaks into your home high as a kite and etc, and you pop him in the head with a nice shot.

    murder.....

    then the next day your neighbour accidentaly kills some guy with a paintballing fiasco that went all wrong.

    murder........

    would a judge look differently on the two cases, considering a knacker has no morals or conscious, I would think he/she should.

    Well they are 2 different cases for a start. One is murder/self defence in a house, the other is...eh...what? Paintball accident? Did the person in the gaf get killed by a paintball too?

    (ignoring the fact that, yes of course, it is quite literally wrong).

    Switch the roles... say the guy who was murdered via paintball actually broke into the house and visa versa... would it still be the same?

    ones murder / self defence, the other is accidental manslaughter.

    you could consider the first one as second degree murder.

    if he was as high as a kite he wouldn't have been much of a challenge though cos he;d probably be sitting on your couch watchin oprah and eating dry crunchy nut cornflakes outta de box.

    Like a few people have already said was one accidental the other was (more than likley) intentional.

    ANother little issue may be is this a legal gun you have?

    From my (limited) gathering of the law, I think it works like so long as he doesnt attack you, you cant attack him. And if he does attack you or your family, then you can only use reasonable force.

    However if I found myself in that situation, not that I would go for a headshot.... I would say that I had the gun pointed at him to keep him back... then while telling him to get out of my house he made a very sudden jump and without thinking (and regretfully) shot him....
