    Hi,

    These are my points..

My friend has opened a new company along with his wife.
He is the secretary / Director of this company.

He is here on a dependent VISA.

The company was formed to provide Media and IT Consultancy service online.

Can he apply for a work permit (Green Card) if the company wishes him to hire him as an employee with salary over 30k?

    Thanks.

I believe not. The department would have to be shown that there is no Irish person able to do the job to justify him getting a green card. Also, they may look at the setting up of the company as a trojan horse to get him a Green Card.
I advise contacting a legal specialist about this.

i don't think he should have established a business here without special leave from the Minister for Justice. He really needs to contact a solicitor specialising in immigration matters.

    Thanks for the replies....

The company was not formed for him to apply for a green card.

He was doing his online consultancy work even before he opened his company.

The customers had to pay him..there was no option other than opening a company and receive money in its name and comply with all statutory requirements.

There are only a few specialists in this area in what he is working.

    Is he missing something here??

    To OP,

Have seen you posted this before somewhere here. I think that you are missing some points here from other posters. It is unclear on what ground that your friend has been doing business here.

Assuming he's a non-EEA/EU citizen, generally he must first have business permission from Minister for Justice to run any business in Ireland. My opinion is that self employed individual and setting up companies would be deemed as running own business.

Again, this is not the place for seeking legal and professional advices. No, this is not a right place to do so.

    M.
