My old traded car is being driven by someone in my name

    Hello everybody. Bit of advice needed?

    I traded in my old car a year ago with a motor company that went bust soon after. Just the other day I got a bill for the M50 toll gate. Obviously someone has taken my old (and I thought knackered) car and rejuvinated it. Only problem is the garage owners did not re-register the car to this new persons name. What is my first step to solving this problem?

    Tell the M50 toll gate (in writing/email) that you sold the car, send a copy of any documentation if available. Report it to the gardaí & vehicle registration authority as well otherwise you could also end up with speeding tickets as well.

    Someone probably just swiped the plates of this car and fitted them on a similar model in order to dodge the toll.

    from the situation the OP describes I'd say its more likely whoever has the car just didn't re-reg it.

    follow the advice above OP, inform gardai and M50 and ask gards what to do from there.

    I thought it was the responsibility of whoever was selling/trading a car, to register change of ownership.

    But if you trade it in, not all garages will do the paperwork properly and change the ownership.

    Then you should insist. The onus is on the seller to return the change of ownership form to the relevant authority, it would appear the OP did not do this. No help in the current situation I know but a lesson for others.

    I agree with those who advocate a quick trip to the Guards ASAP. There may be legal implications to you for stuff like if the guy hits someone/something and leaves the scene but someone gets the reg. They should be able to give you an overview and tell you where to go next.

    I would get in contact with the motor tax people at http://www.environ.ie/en/LocalGovernment/MotorTax/ - they were very helpful when I had a similar problem a few years ago.

    My old car was still in my name. I had to write a letter to say what had happened and get it signed by a commisioner of oaths (at a local solicitor). This cost £5. I was then able to get myself moved from current owner to previous owner, even though I didn't have the name of the current owner.
