Speeding - method of proof

    Quick question. Is it actually possible for the Gardai to fine someone for speeding, based on their cars speed when a car overtook them? Just always thought the method of proof would be needed and proof being a speed gun?

    Just seems unusual if fines can be issued so easily with little proof. Curiosity on my part. :)

    Seen a Garda car cruising along in the slow lane a couple of times... everyone was afraid to overtake them :rolleyes:

    yep, as the garda is inferring the accused's speed from an instrument, namely the garda cars speedometer

    road traffic act only requires corroboration where a gardas opinion of the speed of a vehicle is used

    I've never seen anybody prosecuted specifically for speeding relying on a garda speedo.

    I have seen people prosecuted for dangerous/careless driving/driving without due care and attention where the garda evidence includes that the garda was doing x per hour and was overtaken, or had to do x per hour to catch up with the offending vehicle in order to show the speed was dangerous/inappropriate.
