Tenants's Right to Leave?

    At the start of the college year three of us signed a lease to last 9 months-until May respectively. Since then one of us decided to leave after Christmas which the landlord agreed to as long as he found somebody else to take his room. This guy has made no contract with the landlord. He has become extremely hard to live with. He constantly has people over making noise,taking over the living quarters and using without permission our rooms for his friends to sleep over when we're not there(no locks on the doors). The situation has become intolerable and we are finding that it is having an effect on our studies and general comfort in the house. We have decided to look for somewhere else and are wondering if this will be likely to be ok legally?The house is in perfect condition and we are willing to offer our deposits as rent for the last month weve been there.

    If you've signed up to May then you've to pay each months rent up til then.

    Did you not interview this person before they moved in?

    What has your landlord said about him?

    No,we said to the landlady that we didnt feel comfortable with him before he moved in but she said if we didnt allow it we would have to cover the cost of his rent between us. Nobody interviewed him before he moved in....

    You could also have found someone else suitable yourselves, it's not really up to the landlord to do this, as all three of you signed a lease till May, more fool you for not taking the situation into your own hands.

    Legally, you owe rent till May. Deposit is returned if the place is in good condition (bar wear and tear) and all utility bills have been paid up.

    You would need to pay the remaining rent. In practice, however, if you walk away now and leave your deposit there is bugger all the landlord can do about it.

    Have you ever sat this person down and gone through what's acceptable and what is not?

    Can you ask the landlady to put locks on your doors? I really cant understand why you dont have locks in a houseshare, any college digs I've been in always have personal locks on bedroom doors.

    Ask the landlord for permission to change / fit locks on the bedroom doors.

    Strictly speaking, seeing as you have signed for the 9 months, you might be stuck with paying for the 9 months. That you pay monthly is a matter of convenience.

    Can I suggest that you talk to Threshold? As I understand it, you are effectively sub-letting the room to this guy and he is only a lodger. Lodgers are only entitled to reasonable notice to move out. Be wary of him having the party of all parties before he goes though.
