claiming for a crash

    well 1st of all i wasnt really sure where to write about this. and i can guarantee you now after talking about it ur man will contact me.
    but i need to know...

    just before christmas i was involved in a crash. my car slid out on a patch of ice onto a road and someone hit me. i accepted responsibility.the guards were not called... so please do not say they should have been, believe me im aware i should have involved them.

    in this my car was written off, tho his own, the visible signs were a cracked side panel.

    i agreed that this was not to go through my insurance and that i would cover the costs.

    immediatly he sent the car to the garage, i asked for a written quote which came back at 2 grand for his car. which we agreed to pay when christmas was over. a month after the crash date he had still not called me back. then about 2 weeks ago he called, told me the car was in the garage, that it wud take a week to repair. i then agreed to pay the garage directly... he has since not contacted me again and i have seen him driving past in the car that is supposed to be in the garage.

    there were a few odd things about the crash.
    1 being while i slid out in front of him, he should have been able to stop, as the traffic behind him all managed to.
    2 he did not try and avoid me. there was plenty of space to swerve
    3 he got out of the car and told me the water filter needed repairing when there was no visible sign of it. ie no puddle on the ground and no visible crack
    4 the garage that he got his car repaired in shouldnt allow him to leave without some sort of payment... which i had not provided. so im wondering if he knows someone in the garage.

    anyway my question after all this is im aware he can claim up to 6 months after the crash. but he really is in no hurry to claim this money back as far as i can see. im wandering how long he has to claim for the initial claim?

    Notify your insurer ASAP, even if its your intention of settling the claim yourself. Explain the full story to them, and do say that it is you intention to settle it yourself, but you're just letting them know. Will solve alot of problems if your man comes back a few months down the line with a personal injury claim.

    As far as a time limit is concerned, I'm not too sure as I didn;t work in the claims dept.

    If you do settle with him, make sure he signs a statement saying that the payment is full and final settlement, and get copies of receipts.

    Nothing wrong there really, if he swerved and hit something else he would have been liable, f that for a strategy, also if it was icey he would probably lost control.

    I smell a rat as his car is supposed to be in a garage for repairs yet you see him driving it.
    Its a bitter pill to swallow as you admit libabilty and so you will end up paying for the damage to his car regardless.
    As said do get him to sign an agreement that this is a full and final settlement to the claim.

    Contact your insurer anyhow but the fact that you agred to his written quote now makes no difference what he does. You caused the damage and must compensate for it. He does not have to get it fixed though - he can keep the cash and drive around in a damaged car!

    and getting him to "sign an agreement that this is a full and final settlement to the claim" is useless.
    He still had lots of scope to place an injury claim against you and has 2 years from the date of the incident to do so.
    btw - you were right to offer to pay the garage directly, good call on that.

    Pls notify your insurance company asap. just so that you have it on record from your side of events. it is vital that you do this.

    The car not been in the garage is not really anyhting to do with you, if you agree to settle privately he can keep the money and not have his veh repaired at all. it is his choice.

    You skidded into his path so even if he did not even tap his brakes you are at fault and liable for the accident.

    Even though he didnt swerve it means nothing as I said you went into his path.

    He may know the garage but again he can use any grg he wants.

    Defo notify your insurance as you may not be hearing from him as he may be claiming from his own insurance co or making a big personal injury claim on you.

    He has 2 years to claim for property damage

    again with the insurance company suggestion. let them deal with the claim for you. you can probably opt to pay back the insurance company once they settle it anyway.

    We think though he might be 'pally' with the garage

    I am unsure about going to insurance company as i think there may be a possibility that they will raise my qoute regardless of who pays... is this possible?

    He has two years from date of accident to claim for personal injury and 6 yrs for material damage.

    let your insurers deal with the matter--they should be able to reduce the repair costs.
    If you want to refund the insurers and retain your NCD they will allow you do this.

    That sounds like a good idea to me. as i'm not actually sure this amount of damage was done to his car. But all though this does not affect my ncd, will it affect my qoute for other years, as there will be history of a crash. As i am on a company policy... If they raise the qoute, I am under the impresion it'll be raised for each member.

    If you're on a company policy and you don't own the company I wouldn't worry about it, accidents happen, that's why you have insurance. I would have thought the company would have wabted you to inform them and the insurance straight away.
