To sue or leave it be?

    Hi,

    My car broke down, went to a garage they took the car and said I needed to get a new fuel injector pump since that was the thing that was broken. I got a second hand one for them and they put it on, since it would stand 2000 E for a new one. After they fitted the second one they said it is not the fuel injector pump it is the EDU. So I got that part as well, they fit that in the car was not working fine, they told me to get another part ETC which I did. After that the car was still not working properly so I would not take the car. A second mechanic in the garage took it, because the first one got let go and the first told mechanic told me he did not set up the something around the timing belt, broke the plastic, water pump was gone, and finally some valve thing that broke during the stages they took of the fuel injector pump. After that the ignition barrel snapped and they told me it could happen to anyone so I had to get new one so they fit it in. The car is in the garage about 3/4 months and I am fed up waiting and paying for all the parts that were not damaged by me, but rather their mechanic.

    I went to the garage today and told them I want the car by end of Saturday, or I will sue. In the garage they told me I can not prove anything and that they would just say everything was broken on the car, and that they are not even going to fix the car, that I can take it home in a broken condition.

    I have receipts of most of the parts, would it be worth suing?-. and would I have any chance of winning because I lost up to 1500 e in parts and I had to get a second car during the these 3/4 months that my initial car was in the garage.

    Well...this is sort of exactly what you're not supposed to do on this forum.

    Broadly speaking, go to a solicitor. He or she will tell you that you need to commission an independent mechanic who is willing to go to court on your behalf to give evidence that your car was repaired negligently or in breach of contract (he'll need to inspect and do a report before he knows what he or she will say). Hard to estimate cost of same - a solicitor will advise - but you will likely be asked for money up front. As to whether that is throwing good money after bad, no one could possibly say.

    What I would say is that it seems to be a case where you don't have to sue as thankfully the consequences are (relatively, in the scheme of things) minor.
