Insurance Question...slight rant

    Ok lomg story short....driving into town Friday morning, the car in front of me stops dead,I brake hard and the guy behind hits me with full force up the rear...aside from my initial shock and whiplash the car had no visible damage.

    So I take the car to the garage and he says all the damage is in the boot and back panal looking at €1700 to repair,fair enough its the other guys insurance...anyway I was happy with this today I get told the car will be written off with a Book Value of €2000.

    I should mention that I was driving a 01 Clio Sport 1.2 85,000miles 2 year NCT, fair enough to them thats worth €2000,to me its worth way more, I will not get another good car like this for that price and am in no position to borrow to add to it to get a decent car...

    So my question is why should the innocent person have to suffer the loss of there car and be out of pocket to buy a new one coz some idiot didn't hit the brake in time!!!:rolleyes:

    You don't have to have the car written off, you can have it repaired.

    Take the €2000 off them and buy the car off them for the salvage price :)

    Yes, uneconomical to repair from their point of view. You can take the value of the car (minus the scrappage value) and have it repaired at your leisure.

    They give you the €2000. You buy the now scrapped car back off them for the price of the scrap. Talk to them, they'll know what we're on about.

    Thanks for the replies...they were having none of that, the car is gone and I have 3 days to find a new one before I have to give back the courtesy car :rolleyes:

    How so ? They can't take the car off you, it's your car.

    Their engineer looked at it said its not worth repair and that they dospose of it..I get a cheque in the post and thats the end of it...apparently.
    Probably better off as its probably not safe to drive anyway!

    sounds like the insurance company was pulling the wool over the eyes of somebody that doesnt understand the workings of the situation.

    So?? It's not a matter of uneconomical to repair, it's a matter of getting the other guy's insurance company to fix it back (As it can be repair per garage advise)..

    I think the insurance company is chancing their arm and try to cut their loss.. which mean you get the stick up the back side on the other end

    unless you have given your permission they cannot take your car and dispose of it... thats called theft!!!

    if you haven't given permission, and still have all the paperwork, vlc ect... I would ring the insurance company and threaten to ring the garda... they took and refuse to give back your car.... unless they are willing to up the settlement ;)

    the car will not be destroyed until the deal is agreed and the VLC in the hands of the scrap yard.

    The scrappage must be done properly and verfied.

    Dont forget your only entitled to the market value of the vehicle not what you believe the car is worth.

    Ask your own motor assessor to inspect the car and put a value on it so you can argue with the insurers with a proper valuation report in your hands.

    Dont forget that the 2nd hand car market is in the doldrums at the moment.

    You need to pay for the report but you can try and claim it back fom the insurers especially if you get an increase in the valuation after submitting the report.

    I think both Tommy21 and the OP should chat with a solicitor.

    for the OP..... you said you experienced whiplash - are the insurance company trying to get the claim over with and ignoring your injuries, if you have suffered whiplash get seen to by a doc.

    unfortunatly you car is only worth about 2K at the most, i've just agreed to sell the wife's 03 Ibiza with less milage and in great nick for just over two grand.

    your 2 grand will get you 'back to the position' you were in prior to the accident.

    Tell insurers you will settle for market value less the scrap/salvage value they have on the car and that you will keep the car. That way you should get 1500 at least and get to repair the car.
    I also feel that if the quote for insurance purposes for the repair was 1700, it will certainly be possible to get your car into a very respectible state if its just the back panel and perhaps the alignment of the lock for a small amount of money. The insurance quote would have been for replacing every minor bit of damage to an as new condition. You will certainly get away with less works than listed on that quote.
    If you dont do this, the insurers will pay you the 2000. They will then offer the car around a few garages (if worth it) for next to nothing and then a garage will spend a few euro and flog it again making some money on it.
