Can anybody tell me how do you know if you are entitled to free legal aid when going for a seperation, this would be a judicial seperation on grounds of husbands alcoholism. I know that you have to earn under a certain amount to qualify for free legal aid but is this income based on my income which is nil as i am at home or is husbands income taken into consideration even though he is not the one instigating the seperation proceedings. Thanks

im sure you will get more detailed info here, but i would advise you to get in contact with your local citizens info office www.citizensinformation.ie and also speak to someone at flac.ie (free legal advise centres).
theres also a free service for family mediation that can work well but ONLY if both parties are committed to actually taking part. http://www.fsa.ie/

like i said though you might get more replies here with more info as im not really qualified or anything in this area :)

    hi there,

you are quite correct there are thresholds of income which categorise those who do and do not qualify for legal aid.

If your income is zero, then you've a significant chance of qualifying for legal aid. Ring FLAC-the free legal aid centre and they will advise you which centre is nearest you and you go speak to a practitioner who will be able to assist you and point you in the direction of a legal aid family solicitor.

www.flac.ie and the citizens information bureau will assist you to no end.

    Here's the Income level page

Seek proper legal advice on what you can 'get away with' then do what you think is fair over and above that.
