A general observation that I have made from reading SC judgments over the last five years is that Macken sits in very rarely on SC cases. Does anyone know why this is, or am I understating her role in the SC's work?

The Chief Justice assigns the case lists

Mrs Justice Macken used to sit on civil matters (contrast with Mr Justice Hardiman who sits alot in criminal matters). I think, and I can not substantiate this, but I'd imagine its based on areas of gross-familiarity and putting Judges with expert knowledge on certain cases.

Bare in mind, there appears to be a bit of a shake up over the summer with Mrs Justice Macken sitting on the Reade case.

I don't think I need to go into the deluge that erupted post that judgment. Needless to say it has stalled incredible amounts of cases in the Circuit Criminal Court. There will definately need to be a pronouncement on it again as the law has gone into a bit of uncertainty post the judgment
