Hold Switch not working on ipod nano

Hey. I have an ipod nano. Im not sure about the generation, its the latest one, but without the camera. The hold switch has just completely crapped out on me. Its not working at all. Its not just the fact now that it does its own thing in my pocket, but when I leave it down, and turn it off by holding down the play button…

Its not just the fact now that it does its own thing in my pocket, but when I leave it down, and turn it off by holding down the play button it comes back to life. I can see it on my desk relighting ever 10 minutes for no reason. Then when I do go to use it, its out of battery.

Anyone have any suggestions? Anyone heard about this. Is it a software glitch/hardware glitch. I've tried the reseting it, but that doesnt help.
