Court Summons

    This is to do with a tv licence in rented accomodation.
    I realise queries about these prob come up alot on forums?

    Need some opinions on this one. An inspector came around to my house and asked for name "X" who wasnt living there ANYMORE, he then proceeded and asked me for my name. I give my name but this inspector wrote it down incorrectly.

    Instead of taking down my name as Sean brady the man wrote Sean barly.

    I moved out of the house a few weeks after this. (mid september)

    So i got a call then from one of the new tenants of the house in december saying that there was a Post Office receipt for a package dropped off and that i had to collect it in the nearby post office.

    So i went up to collect it and after signing for it i discovered that it was actually a court summons for Sean Barly? The court appearance is next thursday (28th)?

    All opinions welcome.

    You would normally still have to attend even though your name is spelt incorrectly. The complexity of rules of summons can be confusing.

    Usually a garda would have your correct details such as D.O.B on file etc and the mistake on the summons can be rectified by your appearence.

    However in your particulat situation there is no control name unless your mistaken that the tv inspector made the mistake. If he did indeed make the mistake then a Sean Barly will be convicted in his absence.

    I would perhaps go so far as to contact the tv inspector and clear the matter with him first. That way you will know what name he is working from.
    He might agree to let the matter go.

    Did the "inspector" identify himself as a TV Licence inspector and ask you if you had a TV and how did you answer?

    Since (at the time you noticed) the inspector wrote down your name wrong, he may has mis-heard you, and might (not unreasonable) claim that that was the name you gave, and you might be done for giving a false name....
